Note: These terms govern your use of thenerdstack.com(the “website”). Paid project engagements are governed by a separate signed agreement — these terms do not replace or modify any project contract.

1. Agreement to terms

By accessing or using thenerdstack.com, you agree to these terms of service. If you do not agree, please do not use the website. We may update these terms from time to time; the effective date at the top reflects the most recent version. Continued use of the site after a change constitutes acceptance of the new terms.

2. About Nerd Stack

Nerd Stack is a Denver, Colorado-based web development agency. We provide custom website design, development, maintenance, redesigns, CMS solutions, custom web applications, and cold email outbound systems for small and medium businesses. The information on this site describes our services in general terms; specific scope, deliverables, and pricing for any engagement are set forth in a separate, signed proposal or agreement.

3. Permitted use of the website

You may use this website for lawful purposes — to learn about our services, contact us, read our blog, request a free audit, or book a consultation call. You agree not to:

  • Use the website in any way that could damage, disable, or impair it
  • Attempt to gain unauthorized access to any part of the site or related systems
  • Use automated systems to extract data from the site in a way that exceeds reasonable use
  • Submit false or misleading information through our forms
  • Use the site to send spam, malware, or any other harmful content

4. Intellectual property

The content on thenerdstack.com — including text, design, graphics, code, the Nerd Stack name and logo, blog content, case studies, and underlying technology — is owned by Nerd Stack or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share the content for personal, non-commercial purposes with attribution. Any other use requires our prior written permission.

Content created for clients during paid engagements is governed by the terms of the separate project agreement — typically the client owns the deliverables on full payment.

5. Submissions through forms

When you submit information through our contact form, free audit form, or scheduling tool, you authorize us to receive and respond to that submission. Information submitted is handled per our Privacy Policy. We are not obligated to respond to or act on any submission; the act of submitting does not create a client relationship or any obligation on our part to provide services.

6. Free website audit

We offer a free website audit as a no-obligation service to prospective clients. Requesting or receiving an audit does not create a contractual obligation by either party. The audit represents our professional opinion based on information available at the time of review; it is not a guarantee of performance, ranking, or business outcomes.

7. Third-party links

Our website contains links to third-party websites and embedded third-party tools (for example, our scheduling widget). We are not responsible for the content, privacy practices, or terms of those third parties. Following an external link is at your own discretion and subject to that third party’s terms.

8. Disclaimers

The website and its content are provided on an “as is” and “as available” basis. While we strive for accuracy, we make no warranties or representations — express or implied — about the completeness, accuracy, reliability, suitability, or availability of any information on the site. Blog content, guides, and case studies are educational in nature and do not constitute legal, financial, or professional advice for your specific situation.

9. Limitation of liability

To the fullest extent permitted by law, Nerd Stack and its team will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the website — including loss of profits, data, or business opportunity — even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the website is limited to one hundred U.S. dollars ($100). For paid engagements, liability is governed by the separate project agreement.

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising from these terms or your use of the website will be resolved in the state or federal courts located in Denver County, Colorado.
